Welcome to EditWiz, a dba of Monaco Media LLC. By subscribing to our services, you agree to be bound by the following Terms and Conditions. Please read them carefully.
EditWiz provides creative content creation and editing services for businesses and personal brands. These services may include, but are not limited to:
• Video editing
• Image and graphic design
• Branding assets and logos
• Audio editing and voiceovers
• Generative AI content
• Funnel and website design
• E-books and marketing materials
(collectively referred to as the "Services").
EditWiz reserves the right to modify, improve, or discontinue certain Services at any time.
2.1 Subscription Model: Our services are provided on a subscription basis with a flat monthly fee.
2.2 Billing Cycle: Your subscription will be billed monthly in advance, on the same day of signing up, every month.
2.3 Pause or Cancel: You may pause or cancel your subscription at any time with a minimum of 10 days' notice before the next billing cycle. If notice is not provided within this timeframe, the subscription will continue to the following month.
2.4 Subscriber Roles: The subscriber has full responsibility to request, manage, retrieve, and provide with the contents necessary in order to receive finished digital products and services; in other words, even if the subscriber does not request a project or "content piece", or subscriber is unresponsive, or any other lack of communication or miscommunication, the subscription remains functioning as usual, and does not qualify for any dispute or refund.
2.5 Refunds: No refunds will be provided, except if there is a service failure like, but not limited to, technical issues, case-by-case scenarios like medical emergencies, natural or human-induced disasters, or any unforeseen events that prevent you from using the services.
2.6 Failed Payments and Late Fees: If a subscription payment is declined and the charge fails, EditWiz will notify the Subscriber via email or another registered communication method. The system will retry the payment up to three (3) times within seven (7) days. If payment remains unsuccessful, a late fee of $50 per calendar day will be added to the outstanding balance starting from the initial failed charge. Services will be suspended if the balance is not settled within seven (7) days, and the account will be placed "On Hold" . Continued non-payment beyond thirty (30) days may result in account termination and referral to collections, with additional fees applied as necessary.
3.1 Client Content: Clients retain 100% ownership of their content before and after the editing process. EditWiz will not re-sell or distribute any of the client's content or information.
3.2 Portfolio Use: EditWiz reserves the right to use any content edited by EditWiz for portfolio and showcasing purposes. This includes the use of content in compilation videos to demonstrate the work performed.
3.3 Client Approval for Showcasing: If a client requests, EditWiz will present the specific piece of content intended for use in compilation videos for client approval. Clients have the right to approve or deny such use.
Clients agree not to submit content that:
• Violates any laws or regulations
• Infringes on intellectual property rights
• Is defamatory, abusive, discriminatory, or harmful
• Contains illegal or unauthorized materials
Clients remain solely responsible for the legality and rights associated with the content they provide.
EditWiz agrees to maintain the confidentiality of any non-public client materials, strategies, or proprietary information shared during the course of providing services.
Reasonable technical and organizational safeguards are implemented to protect client data.
By submitting your phone number through our website, funnels, or other forms, you consent to receive SMS communications from EditWiz related to:
• Service updates
• Account notifications
• Marketing and promotional messages
• Appointment reminders
Message frequency may vary. Message and data rates may apply depending on your mobile carrier.
You may opt out of SMS communications at any time by replying STOP to any message. For assistance, reply HELP.
SMS consent is not shared with third parties or affiliates for marketing purposes. Phone numbers and SMS consent may only be shared with trusted messaging providers strictly for the purpose of delivering SMS communications on behalf of EditWiz.
SMS Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.
6.1 No Warranty: EditWiz provides the services "as is" without any warranties, express or implied.
6.2 Liability Limit: In no event shall EditWiz be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of their services.
Clients agree to indemnify and hold harmless EditWiz, its affiliates, officers, employees, and contractors from any claims, liabilities, damages, or expenses arising from:
• The use of EditWiz services
• Client-provided content
• Violations of these Terms and Conditions.
EditWiz reserves the right to modify these Terms and Conditions at any time.
Updated versions will be posted on this page and become effective immediately upon publication.
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles.
